AfriTrade Express – Terms and Conditions

Welcome to AfriTrade Express! These Terms and Conditions (“Terms”) govern your use of our platform and services, including our website, mobile app, and any related services provided by AfriTrade Express (“we,” “us,” or “our”). By accessing or using AfriTrade Express, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should discontinue use of our services immediately.

1. Acceptance of Terms

By using AfriTrade Express, you affirm that you are at least 18 years of age and are capable of entering into a legally binding contract. If you are using AfriTrade Express on behalf of a business or entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Services Provided

AfriTrade Express connects buyers for the trading of goods and services across Africa. We facilitate communication, listing, and transactions, but we do not take ownership of goods or guarantee the fulfillment of agreements made between users.

3. User Accounts

To use certain features of AfriTrade Express, you may be required to create an account. You agree to:

  • Provide accurate and up-to-date information during registration.
  • Maintain the security of your account by keeping your login credentials confidential.
  • Accept full responsibility for all activities under your account.
  • Notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to engage in any of the following prohibited activities:

  • Violating any local, national, or international laws while using our platform.
  • Using bots, scrapers, or other automated systems to access or disrupt the platform.

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these Terms or any applicable law.

5. Payment Terms

  • Payment methods available for transactions on AfriTrade Express are listed on our platform. We are not responsible for third-party payment provider issues or delays.
  • Users are responsible for all fees associated with listing, selling, or purchasing goods on AfriTrade Express.
  • Disputes between buyers and sellers regarding payment or non-delivery must be resolved between the parties involved. AfriTrade Express may, at its discretion, assist in resolving such disputes, but we do not guarantee any resolution.

6. Shipping and Delivery

  • AfriTrade Express is responsible for arranging shipping and ensuring that goods are delivered per the agreement made with the buyer.
  • Buyers are responsible for providing accurate shipping information.
  • AfriTrade Express does not bear responsibility for lost, delayed, or damaged shipments.

7. Intellectual Property

All content on AfriTrade Express, including but not limited to text, images, logos, and software, is the property of AfriTrade Express or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our explicit permission.

8. Limitation of Liability

To the maximum extent permitted by law, AfriTrade Express is not liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of business, resulting from your use of the platform or any transactions made through the platform.

9. Disclaimer of Warranties

AfriTrade Express is provided on an “as is” and “as available” basis. We do not warrant that the platform will be uninterrupted, error-free, or secure. We disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless AfriTrade Express, its affiliates, and its respective officers, directors, agents, and employees from any claim, demand, loss, or damage, including legal fees, arising out of your violation of these Terms or your use of the platform.

11. Third-Party Links

AfriTrade Express may contain links to third-party websites or services. We do not endorse, control, or assume responsibility for any content, privacy policies, or practices of such third-party websites.

12. Termination

We may suspend or terminate your access to AfriTrade Express at any time, without notice, for any reason, including but not limited to your violation of these Terms. Upon termination, all provisions of these Terms which by their nature should survive, including ownership provisions, warranty disclaimers, and limitations of liability, will remain in effect.

13. Modifications to Terms

We reserve the right to modify or update these Terms at any time. Any changes will be posted on our website with an updated effective date. Continued use of AfriTrade Express after changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Ghanaian Jurisdiction.
